General Terms And Conditions
Article 1 – Definitions
In these terms and conditions, the following definitions apply:
Cooling-off Period: the period during which the consumer may exercise their right of withdrawal.
Consumer: the natural person who is not acting in the course of a profession or business and enters into a distance contract with the business.
Day: calendar day.
Long-term Contract: a distance contract relating to a series of products and/or services, the delivery and/or purchase obligation of which is spread over time.
Durable Medium: any tool that enables the consumer or business to store information addressed to them personally in a way that allows future reference and unchanged reproduction of the stored information.
Right of Withdrawal: the option for the consumer to withdraw from the distance contract within the cooling-off period.
Business (Seller): the natural or legal person who offers products and/or services to consumers remotely.
Distance Contract: an agreement concluded within the framework of a system organized by the business for the remote sale of products and/or services, whereby one or more techniques for distance communication are used up to and including the conclusion of the contract.
Means of Distance Communication: a method that can be used to conclude a contract without the consumer and business being in the same place at the same time.
Terms and Conditions: the present General Terms and Conditions of the business.

Article 3 – Applicability
These terms and conditions apply to every offer from the business and to every distance contract and order concluded between the business and the consumer in Canada.
Before the distance contract is concluded, the text of these terms and conditions will be made available to the consumer. If this is not reasonably possible, the business will indicate, before the contract is concluded, how the terms and conditions can be accessed and that they will be sent free of charge upon request.
If the contract is concluded electronically, these terms and conditions may also be made available electronically in such a way that the consumer can store them easily on a durable medium.
If specific product or service conditions apply in addition to these general terms, the consumer may always invoke the provision that is most favorable to them.
If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue in effect, and the invalid provision will be replaced with one that closely matches the original intent.
Situations not covered by these terms should be interpreted “in the spirit” of these terms and conditions.
Article 4 – The Offer
Each offer is subject to change and valid while supplies last.
The business reserves the right to modify prices, descriptions, and product details at any time.
Apparent errors or inaccuracies (including typographical or pricing errors) are not binding.
All offers are presented in Canadian Dollars (CAD) and include or exclude sales tax (GST/HST) as indicated on the checkout page.
Article 5 – The Agreement
The agreement is concluded at the moment the consumer accepts the offer through the online ordering process and meets the conditions set out therein.
After completion, the consumer receives an electronic confirmation of their order.
If the business cannot fulfill an order, the consumer will be notified and refunded if payment has already been made.
Article 6 – Right of Withdrawal (Return Policy)
For the purchase of products, the consumer has the right to cancel the contract without giving reasons within 14 days of receiving the product.
During the cooling-off period, the consumer must handle the product and packaging with care.
They may only unpack or use the product to the extent necessary to determine whether they wish to keep it.
To exercise the right of withdrawal, the consumer must notify the business in writing (via email) within the 14-day period.
After notification, the consumer must return the product within 14 days. The consumer must provide proof of return shipment.
If the consumer fails to notify or return the product within the specified periods, the purchase becomes final.
Article 7 – Costs in Case of Withdrawal
The consumer is responsible for the cost of return shipping.
If the consumer has already paid, the business will refund the amount within 14 days of withdrawal, provided that the returned goods have been received or proof of shipment has been supplied.
Refunds are issued in Canadian Dollars (CAD) using the same payment method used for the original purchase.
Article 8 – Exclusion of Withdrawal Right
The right of withdrawal may be excluded for products:

Custom-made or personalized items;

Items that by nature cannot be returned;

Perishable goods;

Items where the seal has been broken (such as hygiene products, software, media).
Article 9 – Price
All prices are listed in Canadian Dollars (CAD).
Applicable sales tax (GST/HST/PST) will be calculated at checkout.
Import duties, if applicable, are the responsibility of the customer.
All prices are subject to typographical or technical errors.
Article 10 – Conformity and Warranty
Products must correspond to the description and specifications as presented on the website.
If a product is defective or not as described, the consumer must notify the business within a reasonable period.
The warranty does not affect any statutory rights granted under Canadian consumer protection laws.
Article 11 – Delivery and Execution
The business will exercise the utmost care in processing and shipping orders.
Orders are shipped within 30 days unless otherwise stated.
If delivery is delayed, the consumer will be informed.
Risk of loss or damage passes to the consumer upon delivery.
Article 12 – Long-term Contracts: Duration, Termination, and Renewal
For recurring services or subscriptions, termination must be made at least 14 days before the next billing period.
No automatic renewal will occur without the consumer’s explicit consent.
Article 13 – Payment
Payments must be made at checkout using accepted payment methods (such as credit card, PayPal, or Apple Pay).
Orders will not be shipped until payment is received in full.
Article 14 – Complaints Procedure
Complaints must be submitted within 7 days after discovery of any defects or issues.
The business will respond within 14 days with a proposed resolution.
If a complaint cannot be resolved, it may be submitted to a relevant consumer protection authority in Canada.
Article 15 – Governing Law
These terms and conditions and any disputes arising from them shall be governed exclusively by the laws of the Province of Ontario, Canada, without regard to conflict of law principles.
Any dispute shall be submitted to the competent courts of Ontario, Canada.
